TERMS AND CONDITIONS

PLEASE READ THESE TERMS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS.

Contract of short term accommodation

You as a guest (Guest) made a booking of the premises for the short term rental (Accommodation) advertised by the owner (Host) through a booking channel (Site, Agency or Application). Unless otherwise agreed, the key terms for Accommodation are those provided to you via the booking channel which processed your booking.  In case of conflict between any key terms provided and these Terms and Conditions (“T&C”), the present T&C shall prevail.

The Host provides Guest with the right to use and enjoy Accommodation listed by the Host and booked by Guest through the Site, Agency or Application. By booking the Accommodation through the Site, Agency or Application, you agree to comply with and be legally bound by these T&C. If you do not agree to these T&C, you have no right to use and enjoy Accommodation and your booking with the Host shall be deemed to be cancelled immediately per the cancellation policy contained in your booking.

YOU ACKNOWLEDGE AND AGREE THAT, BY REQUESTING, BOOKING AND ACCEPTING ACCOMMODATIONS PROVIDED BY THE HOST, YOU ARE INDICATING THAT YOU HAVE READ, AND THAT YOU UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS CONSTITUTING THE CONTRACT OF SHORT TERM ACCOMODATION.

Payments and cancellations

All payments are made via the booking channel that processed your booking with the cancellation policy that applies accordingly.

For direct bookings processed via the Host Site an advance equal to 20% of the total rental amount is charged upon booking confirmation. The remaining 60% of the total rental amount is charged in 2 months and the last 20% in 1 month before the check-in date. A confirmation is provided for the receipt of each payment. Failure to pay the agreed amount on the due date will legally and without proof of default entail cancellation of your booking. Amounts paid are not refundable in case of the cancellation.

Deposit for possible damages

Deposit agreed upon the booking must be paid upon check-in date at the latest. This deposit will be refunded no later than 1 week after the check out date subject to the absence of any issues or damages. In case of disappeared objects and damages to buildings/furniture/equipment, items that have been removed or other problems, the costs of restoring the Accommodation to its original state are deducted from the deposit.

Insurances

The Host holds fire insurance and general building insurance policy. The Host is not responsible for lost items and accidents caused by the Guests or their party. Should you wish to take any additional insurances, please contact yours or our insurance broker for the special arrangements; the contacts for that can be provided.

Limitation of liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR BOOKING OF ACCOMMODATION, YOUR USE OF THE PREMISES DESCRIBED IN THE BOOKING AND ANY EVENTS OCCURRING ON THE PREMISES DURING YOUR STAY WITH THE HOST REMAINS WITH YOU. USE OF THE SWIMMING POOL, FIRES OR ANY OTHER FACILITIES ARE ENTIRELY AT YOUR OWN RISK. NEITHER THE HOST NOR ANY OTHER PARTY INVOLVED IN YOUR STAY WITH THE HOST WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES. IN NO EVENT WILL HOST’S AGGREGATE LIABILITY ARISING OUT OF THIS CONTRACT OF ACCOMMODATION EXCEED THE AMOUNTS EFFECTIVELY PAID TO THE HOST FOR YOUR BOOKING VIA THE SITE, AGENCY OR APPLICATION.

Waste removal and cleaning

Guests have responsibility for putting back all the items used indoors and outdoors (furniture, glasses, crockery, etc.) in its original state where they belong. Empty goods (bottles, packaging, boxes), any waste or trash must be disposed of by the Guests into dedicated garbage containers on the street in front of Accommodation. Regular cleaning is included in the rental fees; in the event of the disproportional disorder and special cleaning requirements to the furnishing textiles, carpets, walls, additional fees can be charged out of the deposit.

Special conditions

Check-in and check out upon your arrival and departure, bringing in any pets, organizing parties or other events must be priorly agreed upon your booking.

There is a general smoking ban indoors in the premises. Any cigarette buds left or disposed of outdoors must be cleaned up and taken away by the Guests.

Any additional issues can be discussed and resolved upon request.

Dispute resolution

Any complaints must be communicated by the Guests to the Host immediately by telephone or email and then confirmed in writing within 5 days of any incident. Any disputes, including those related to the payments, refunds and damage claims, that cannot be resolved in good faith by the amicable agreement of the parties, should be submitted to the consumer arbitration system in Spain (Sistema Arbitral de Consumo) as an instrument enabling the effective and rapid dispute resolution. All parties involved in this Contract of short term accommodation voluntarily accept the resolution of the dispute through the arbitration system.
